The first and most thoroughly developed audience-oriented argumentation text, Argumentation and Critical Decision Making presents argumentation as a cooperative, communicative process. The text examines the general principles of argument in a rigorous yet readable manner and then applies those principles to different spheres of life--law, science, religion, business, and politics--to explore how conventions of argument change when applied to these real-world arenas. Focusing on the dynamics of decision-making and using real-life examples to illustrate principles, this book aims to help readers develop practical argumentation skills within the world of their daily lives. Computer security is a crucial aspect of modern information management, and one of the latest buzz words is "incident response"--detecting and reacting to security breaches. Computer Forensics offers information professionals a disciplined approach to implementing a comprehensive incident-response plan, with a focus on being able to detect intruders, discover what damage they did and hopefully find out who they are.
There is little doubt that the authors are serious about cyber investigation. They advise companies to "treat every case like it will end up in court" and although this sounds extreme, it is good advice. Upon detecting a malicious attack on a system, many system administrators react instinctively. This often involves fixing the problem with minimal downtime, then providing the necessary incremental security to protect against an identical attack. The authors warn that this approach often contaminates evidence and makes it difficult to track the perpetrator. This book describes how to maximise system up-time while protecting the integrity of the "crime scene".
The bulk of Computer Forensics details the technical skills required to become an effective electronic sleuth, with an emphasis on providing a well-documented basis for a criminal investigation. The key to success is becoming a "white hat" hacker in order to combat the criminal "black hat" hackers. The message is clear: if you're not smart enough to break into someone else's system, you're probably not smart enough to catch someone breaking into your system. In this vein, the authors use a number of technical examples and encourage the readers to develop expertise of UNIX/Linux and Windows NT fundamentals. They also provide an overview of a number of third-party tools, many of which can be used for both tracking hackers and for probing your own systems.
The authors explain their investigative techniques via a number of real-world anecdotes. It is striking that many of the same hacks detailed in Cliff Stoll's classic The Cuckoo's Egg are still in use over 10 years later--both on the criminal and investigative fronts. It is up to individual companies whether or not to pursue each attempted security violation as a potential criminal case, but Computer Forensics provides a strong argument to consider doing so. --Pete Ostenson [via]

The core question asked in It's All the Rage casts a long shadow: "Who deserves to die?" This is a book about the death penalty. "Knowledge about it," writes Wendy Kaminer, "is not widely shared--how it is applied and to whom, what it costs and accomplishes. Public perceptions about the death penalty--that it is cheaper to execute people than imprison them for life, that appeals in a capital cases are a great burden to the courts--are almost invariably wrong." Fear, rage, and desire for a simple solution fuel the debate.
Kaminer presents the heated debates on capital punishment, as well as an examination--historically, judicially, ethically--of the phenomenon. Offering a unique viewpoint, she points out the gap between the recovery movement and its soft ethics ("we're all victims of dysfunctional families; feel my pain") and the hard standards applied, for example, to those on death row. How can we sanction whining and irresponsibility in the noncriminal segment of society and cruel and unusual punishment in the other?
Hers is a humor riddled with impatience, straining to hold onto ethics in an ethically slippery time. On the nature of public support for the death penalty: "People don't trust the Postal Service to deliver the mail, or the IRS to enforce the tax code with fairness and good sense; they don't trust the Parking Violations Bureau to process traffic tickets or refrain from towing cars for no good reason. Yet, out of fear or fury or wishful thinking about deterrence, they trust the criminal justice system with the power to put people to death. What is perhaps most notable about the death penalty is its irrationality." This is a strong example of Kaminer's "cutting through the B.S." style. The subject is grim; one hesitates to use the word "entertaining." But It's All the Rage is. Indeed, Kaminer's voice pulls the reader through contradictory points of view; commentaries on some of the decade's more sensational court cases, studies, polls and the inimitable Kaminer extrapolations. This can sometimes feel like a wild ride, but it's well worth the motion discomfort. --Hollis Giammatteo [via]

This collection of essays by philosophers, political theorists, and social critics ranges over two millennia--from the ideas of Plato and Aristotle to those of contemporary thinkers such as John Rawls and Robert Nozick. It examines the nature of justice, its importance in human life, and its place among the other virtues. The scope of the collection gives a clear picture of the differences and continuities that have marked the debate: Plato's emphasis on the ideal of "sticking to one's task" contrasts with the modern emphasis on individual rights, while the account of justice as part of the law of nature offered by Aristotle and Cicero contrasts with Hume's analysis of justice as an artificial virtue. Alan Ryan's introductory essay emphasizes the stringency of justice--showing how its demands can conflict with considerations of the general welfare. The book concludes with a discussion of Marx's view that justice is perhaps merely a concession to a world of scarcity and selfishness created by capitalist necessities. An excellent guide to interpretations of one of the central values of political life and thought, this book will interest students and scholars of political theory and philosophy. [via]

The first edition of this prize winning work sought to recast the discipline of comparative law and provided a new and inclusive means of reconciling the diverse laws and peoples of the world, through placing national laws in the broader context of legal traditions. The new edition further develops these themes.
Glenn examines seven of the world's most important and complex legal traditions in detail; chtonic (or indigenous) law; talmudic law; civil law; Islamic law; common law; Hindu law and Asian law. Each tradition is examined in terms of its institutions and substantive law, its foundations concepts and methods, its attitudes towards the concept of change, and its teaching on relations with other traditions and peoples. Glenn considers both the common influences which have shaped these traditions and the major and important differences between them. Ultimately he demonstrates that despite their differences, the various traditions are fundamentally commensurable and are the best means of facilitating human diversity in an increasingly interdependent world.

Despite what it said in the New York Times or the Congressional Record, not everybody in America got the word right away about the civil rights movement. Thus it was that well into the 1970s, McIntosh County in backwoods Georgia remained a place where the black majority still had never elected one of their own to any county office, where black kids were bused away from the white school, and where the white county sheriff had his hand in every racket there was. Praying for Sheetrock is the saga of how, thanks to the leadership of a black shop-steward-turned-county-commissioner named Thurnell Alston, together with the aid of a cadre of idealistic Legal Services lawyers (Melissa Greene was one of their paralegals) this situation began to change. The story, written as grippingly as a novel, is charged with twists that only nonfiction can deliver; for example, Alston, for all the brave good he did, ultimately got caught in a federal sting and went to jail while the corrupt sheriff walked. This is, writes Greene, a story of "large and important things happening in a very little place." [via]

"What if our criminal justice system is biased against the poor from start to finish - from the definition of what constitutes a crime through the process of arrest, trial, and sentencing?" The author argues that actions of well-off people - refusal to make workplaces safe, refusal to curtail deadly pollution, promotion of unnecessary surgery, prescription of unnecessary drugs, etc. - cause occupational and environmental hazards to innocent members of the public and produce as much death, destruction, and financial loss as so-called crimes of the poor. However, these crimes of the well-off are rarely treated as severely as those of the poor. Reiman documents the extent of anti-poor bias in arrest, conviction, and sentencing practices and shows that the bias is conjoined with a general refusal to remedy the causes of crime - poverty, poor education, and discrimination. As a result, the criminal justice system fails to reduce crime. The author uses numerous studies and examples to illustrate his points, and difficult concepts are explained in a non-technical manner. The book is a useful counter to the uproar about crime. It provokes thought and discussion, even among people who disagree with its content." For anyone interested in issues of class, social deviance, ethics, or criminal justice. [via]

This best-selling text examines the premise that the criminal justice system is biased against the poor from start to finish-from the definition of what constitutes a crime through the process of arrest, trial, and sentencing-and shows that the bias is conjoined with a general refusal to remedy the causes of crime-poverty, lack of education, and discrimination. One reviewer describes this text as "one of the most outstanding critiques of the criminal justice process...a book that needed to be written and needs to be publishing again and again...a text as relevant today as when first published in 1979." The author argues that actions of well-off people, such as refusal to make workplaces safe; refusal to curtail deadly pollution, promotion of unnecessary surgery, and prescriptions for unnecessary drugs, cause occupational and environmental hazards to innocent members of the public and produce just as much death, destruction, and financial loss as so-called crimes of the poor. However, these acts of the well-off are rarely treated as crimes, and when they are, they are never treated as severely as crimes of the poor. [via]
